1. Agreement to Terms

By accessing or using Synthmon's distributed synthetic monitoring service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, agent operators, and others who access or use the Service.

2. Description of Service

Synthmon provides a distributed synthetic monitoring platform that allows users to:

• Monitor website uptime and performance
• Receive alerts when websites are down or experiencing issues
• Run monitoring agents to participate in the distributed network
• Access monitoring data and analytics
• Perform API and browser-based synthetic tests

3. Account Terms

Account Creation

• You must be 13 years or older to use this Service
• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account and password
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

Account Responsibilities

You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction.

4. Acceptable Use Policy

You agree not to:

• Use the Service to monitor websites without authorization
• Perform excessive monitoring that could constitute a denial-of-service attack
• Attempt to gain unauthorized access to any systems
• Use the Service to monitor illegal content or services
• Interfere with or disrupt the Service or servers
• Impersonate any person or entity
• Sell, trade, or exploit for commercial purposes any portion of the Service
• Reverse engineer or attempt to extract the source code of the Service
• Use automated scripts to collect information or interact with the Service

5. Agent Network Participation

If you choose to run a Synthmon agent:

• You grant us permission to use your agent for distributed monitoring
• You agree to maintain reasonable uptime and network connectivity
• You understand that agent performance affects your trust score and points
• You agree not to manipulate or falsify monitoring results
• You acknowledge that agent rewards and points have no monetary value
• Future revenue sharing (if implemented) will be subject to additional terms

6. Service Limits

Free Tier Limits

• Up to 20 monitors per account
• Check intervals: 1, 5, or 10 minutes
• 30-day data retention
• Basic email alerts

Fair Use

We reserve the right to impose limits on accounts that excessively consume resources or negatively impact service quality for other users.

7. Payment Terms

For paid services (when available):

• Billing is processed monthly or annually in advance
• All fees are non-refundable except as required by law
• We reserve the right to change prices with 30 days notice
• Failed payments may result in service suspension
• You are responsible for all applicable taxes

8. Intellectual Property

Our Property

The Service, including all content, features, and functionality, is owned by Synthmon and is protected by international copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of any content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content in connection with providing the Service.

9. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as detailed in the Privacy Policy.

10. Service Availability and Support

Uptime

While we strive for high availability, we do not guarantee uninterrupted access to the Service. We reserve the right to modify, suspend, or discontinue the Service at any time.

Support

Support is provided on a best-effort basis via email. Premium support may be available for paid plans.

11. Disclaimers and Limitations of Liability

Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYNTHMON SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless Synthmon and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• Failure to pay applicable fees
• Fraudulent or illegal activity
• At our sole discretion

Upon termination, your right to use the Service will cease immediately. You may delete your account at any time through the account settings.

14. Governing Law and Disputes
